OpenAI faces 30 new lawsuits over deadly Tumbler Ridge shooting
OpenAI is facing 30 additional lawsuits over the deadly shooting in Tumbler Ridge, British Columbia, bringing the total number of lawsuits linked to the attack to 37 and intensifying scrutiny of how the company handled warnings about the suspect before the violence occurred.
The shooting, which took place in February, killed eight people and injured dozens of others, many of them children. The lawsuits allege that OpenAI's ChatGPT contributed to the shooter's violent behavior and that the company failed to notify authorities despite having identified warning signs months before the attack.
According to court filings, OpenAI's safety team reviewed an account linked to the attacker about eight months before the shooting and determined that it posed a credible and specific threat of armed violence against real people. The company subsequently blocked the account, but the plaintiffs allege that the user was able to create another account and continue using ChatGPT.
The lawsuits accuse OpenAI and CEO Sam Altman of negligence, defective product design and, in some cases, aiding and abetting a mass shooting. The plaintiffs' attorney, Jay Edelson, has argued that the company failed to adequately warn the public about the potential dangers of its technology because of concerns over regulatory scrutiny and negative publicity.
OpenAI has rejected the allegations.
Jason Kwon, the company's chief strategy officer, said OpenAI's safety teams work extensively to protect users and others from potential harm. He also strongly denied allegations that Chief Global Affairs Officer Chris Lehane was involved in the decision not to alert authorities about the attacker, calling that claim false.
The company has previously acknowledged shortcomings in its handling of the case and apologized for not notifying authorities. British Columbia Premier David Eby said the apology was important but insufficient given the scale of the tragedy and the suffering experienced by victims' families.
The lawsuits are among the latest in a growing body of legal challenges examining whether AI companies can be held responsible when their systems are allegedly involved in violent acts or severe mental-health crises.
The Tumbler Ridge case has placed particular attention on how OpenAI evaluates threats identified by its own safety teams, what threshold must be met before information is shared with law enforcement and how the company responds when users circumvent safety measures.
The plaintiffs argue that the company's alleged failure to act on earlier warnings raises questions about whether its safeguards were strong enough to prevent a known potential threat from escalating.
OpenAI maintains that it has continued to strengthen its safety systems and procedures for identifying and responding to threats of violence.
The allegations against OpenAI and Altman have not been proven in court, and the company has denied wrongdoing. The litigation is expected to test the legal responsibilities of AI developers when their products are allegedly used in circumstances involving serious violence.
